Common questions

What happens if someone dies without a will?

Their estate is distributed under the NSW intestacy rules, which may not match what they would have wanted, and an administrator must be appointed by the court.

How often should I update my will?

Review it whenever your circumstances change, such as marriage, separation, a new child, or buying or selling major assets. Even without changes, review it every few years.

Why can't I just use a will kit?

You can, but a will kit can create problems that only come to light when it is too late to fix them. A will that is not signed and witnessed correctly may be invalid, or may need a costly court application. Kits also rarely deal with superannuation, jointly owned property, assets held in trusts or companies, overseas assets, blended families or the risk of a family provision claim. A professionally drafted will usually costs far less than resolving a dispute over a homemade one.
